The legal documents that govern your use of CGA Creative tools, including the Hygienist Clinical Assistant.
CGA Creative ("we", "us", "CGA") provides software tools to licensed professionals. The Hygienist Clinical Assistant ("the Service") is a clinical reference tool that synthesizes publicly available dental literature and drafts patient communication scripts. It is intended exclusively for use by licensed dental hygienists, dentists, and other dental professionals.
The Service is offered on a monthly subscription basis at the rate stated at signup. Founding Hygienist accounts lock in a permanent rate of $19 per month for the life of the account. A free trial of seven days is available; payment method is required at trial start. After the trial, your card is charged automatically each month unless you cancel. You may cancel anytime via the customer portal or by emailing erich@cgacreative.com. Cancellation takes effect at the end of the current billing period. No refunds for partial months.
By using the Service, you represent and warrant that:
The Service is designed to operate within the Clinical Decision Support exemption under the 21st Century Cures Act and is not a regulated medical device. The Service does not diagnose, treat, cure, or prevent disease. It does not analyze medical images. It does not prescribe medication or recommend treatment for any specific patient. The Service surfaces literature and drafts communication aids; you, as a licensed healthcare provider, retain full clinical authority and responsibility for all decisions.
The Service uses large language models to synthesize publicly available literature. AI-generated content may contain inaccuracies, omissions, or misinterpretations. You must independently verify all clinical claims by clicking through to the cited PubMed source and exercising your own clinical judgment before acting on any output. The Service provides citations and quality grades to support this verification.
CGA owns the Service, including all software, user interfaces, and original content. You own the queries you submit and the cases you save locally on your device. Saved cases remain in your browser's local storage and are not transmitted to CGA's servers.
To the maximum extent permitted by law, CGA's total liability arising from or related to the Service shall not exceed the amount you have paid CGA in the twelve months preceding the claim. CGA shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or clinical outcomes. The Service is provided "as is" without warranties of any kind, express or implied.
You agree to indemnify and hold CGA harmless from any claims arising from your misuse of the Service, including entry of PHI, use outside your scope of licensed practice, or use of Service outputs without independent clinical verification. CGA agrees to indemnify you against claims that the Service infringes a third party's intellectual property rights, provided you give us prompt notice of such claims.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of laws principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Essex County, Massachusetts.
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
Cases you save are stored in your browser's local storage on your device. They do not leave your device. Clearing your browser data or using a different device will remove these saved cases.
You can delete your account at any time by emailing erich@cgacreative.com. You can export your saved cases from your browser. You can request deletion of any subscription records held by Stripe through Stripe's customer portal.
Educational reference only. The Hygienist Clinical Assistant is an educational reference tool for licensed dental professionals. It is not a substitute for professional clinical judgment, training, or experience.
Not a medical device. The Service is not cleared, approved, or registered by the U.S. Food and Drug Administration or any other regulatory body as a medical device. The Service is designed to operate within the Clinical Decision Support exemption under Section 3060 of the 21st Century Cures Act (Public Law 114-255), and is therefore not subject to FDA premarket review or quality system regulation.
AI synthesis is not infallible. The Service uses artificial intelligence to summarize publicly available literature. AI-generated content may contain inaccuracies, may misinterpret studies, or may omit relevant findings. You are responsible for independently verifying every clinical claim by reviewing the cited primary source before acting on it.
No diagnosis, no prescribing. The Service does not diagnose disease, recommend treatment for any specific patient, prescribe medications, or analyze medical images. All clinical decisions remain the sole responsibility of the licensed practitioner.
Patient communication scripts are drafts. Patient conversation scripts generated by the Service are drafts intended as starting points. You are responsible for adapting them to your specific patient, your clinical setting, and your professional judgment before any use with an actual patient.
This Service is not HIPAA-covered. CGA Creative is not a Covered Entity or Business Associate under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) for purposes of the Hygienist Clinical Assistant. We do not enter into Business Associate Agreements for this Service.
Do not enter Protected Health Information. By using the Service, you agree not to enter any Protected Health Information (PHI) as defined by HIPAA. This includes, but is not limited to: patient names, dates of birth, addresses, telephone numbers, Social Security numbers, medical record numbers, health plan identifiers, and any other of the 18 HIPAA Safe Harbor identifiers.
The Service is designed for clinical queries that use only de-identified context (such as patient age, relevant medical history, presenting symptoms, and clinical findings, without identifying details). You are responsible for ensuring queries are de-identified before submission.
Your responsibility. Inappropriate entry of PHI by a user does not create a Covered Entity or Business Associate relationship. The user remains solely responsible for any breach resulting from such inappropriate use, and agrees to indemnify CGA against any claims arising from such use, as set forth in the Terms of Service.
